These Terms & Conditions (“Terms”) govern the use of services provided by Toshan Travels (“Company”, “We”, “Us”, “Our”) through www.toshantravels.com. By accessing the website, submitting an enquiry, making a payment, or availing any service, the customer (“Client”, “You”, “Your”) expressly agrees to be legally bound by these Terms.

1. Nature of Services

Toshan Travels acts solely as a travel facilitator and intermediary between the Client and third-party service providers, including airlines, hotels, transport operators, tour operators, visa facilitation centers, and other suppliers (“Suppliers”). The Company does not own, control, or operate any travel service unless expressly stated.

2. Bookings & Payments

2.1 All bookings are subject to availability and confirmation by respective Suppliers.
2.2 Full or partial payment may be required as per Supplier policies.
2.3 Prices are dynamic and may change due to fare variation, currency fluctuation, taxes, or Supplier revisions.
2.4 Any payment made to Toshan Travels shall constitute unconditional acceptance of these Terms and related policies.

3. Pricing, Taxes & Service Charges

3.1 All prices are exclusive of applicable government taxes unless stated otherwise.
3.2 Service charges, consultation fees, convenience fees, professional fees, and management charges levied by Toshan Travels are strictly non-refundable.
3.3 Additional charges arising due to amendments, rescheduling, or Supplier-imposed fees shall be borne by the Client.

4. Client Responsibility & Travel Documents

4.1 The Client is solely responsible for ensuring possession of valid passports, visas, permits, tickets, insurance, and other travel documents.
4.2 Toshan Travels shall not be liable for denial of boarding, entry, or travel due to incorrect, incomplete, or expired documents.
4.3 Clients must verify all booking details immediately upon receipt.

5. Visa Assistance Disclaimer

5.1 Visa assistance is provided strictly as a facilitation service.
5.2 Grant, refusal, delay, or validity of visas is entirely at the discretion of the concerned embassy or authority.
5.3 All visa fees, embassy charges, VFS fees, biometric and processing charges are non-refundable, irrespective of visa outcome.

6. Amendments, Cancellations & Refunds

6.1 All amendment or cancellation requests must be submitted in writing.
6.2 Amendments, cancellations, and refunds are governed strictly by the Cancellation & Refund Policy available on www.toshantravels.com, which forms an integral part of these Terms.
6.3 Toshan Travels shall not be responsible for refund delays or denials caused by Suppliers.

7. Force Majeure

The Company shall not be liable for any delay, alteration, cancellation, or loss arising due to events beyond its reasonable control, including but not limited to natural calamities, pandemics, government orders, airline disruptions, strikes, political unrest, or technical failures.

8. Limitation of Liability

8.1 Toshan Travels shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of enjoyment, mental distress, or financial loss.
8.2 The Company’s maximum liability, if any, shall be limited strictly to the service fees actually received by Toshan Travels.

9. Third-Party Supplier Liability

9.1 Toshan Travels shall not be responsible for acts, omissions, negligence, delays, or defaults of any Supplier.
9.2 All services are subject to Supplier-specific terms and conditions, which the Client agrees to comply with.

10. Indemnification

The Client agrees to indemnify and hold harmless Toshan Travels, its directors, employees, agents, and representatives from any claims, damages, losses, legal costs, or liabilities arising due to:

• Breach of these Terms

• Supplier disputes

• Incorrect information provided by the Client

• Misuse of services

11. Court-Safe Consent & Electronic Acceptance

By using the website, communicating via email/WhatsApp, or making any payment, the Client expressly:

11.1 Acknowledges having read, understood, and agreed to these Terms, the Cancellation & Refund Policy, and all Supplier terms.
11.2 Provides free, informed, specific, and unconditional consent to be legally bound by the same.
11.3 Agrees that electronic acceptance, including website usage, WhatsApp messages, emails, invoices, online payments, or verbal confirmation followed by written communication, shall constitute valid and legally enforceable consent under the Information Technology Act, 2000.
11.4 Waives any right to dispute enforceability on the grounds of absence of physical signature or written agreement.
11.5 Confirms accuracy of all information provided and accepts responsibility for any consequences arising from incorrect or incomplete details.
11.6 Accepts that continued use of services after any policy update constitutes deemed acceptance of revised terms.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, to the exclusion of all other courts.
